Contest Rules

The following general rules (the “Rules”) apply to any contest held by Cominar Real Estate Investment Trust, or one of its shopping centres (the “Organizer”). Each contest shall be supported by a specific form (the “Contest Form”) indicating the name of the contest, its dates, the prizes offered, and any special provisions. In the event of any discrepancy, the Contest Form shall prevail.  


1. ORGANIZER 


The Organizer is responsible for administering the contest.  


2. ELIGIBILITY 


Contests are open to Quebec residents who have reached the legal age of majority. 

The Organizer, its agencies, promotional partners, and anyone living under their roof are excluded.  


3. PARTICIPATION MODE — NO PURCHASE REQUIRED 


Participation is subject to the method described in the Contest Form (e.g., form, kiosk, QR code scan, etc.). No purchase is necessary to enter, in accordance with Canadian laws governing sweepstakes and contests. 

Only one entry per person is permitted, unless otherwise specified in the Contest Form. 


4. AUTOMATIC NEWSLETTER SUBSCRIPTION  


By entering, the person is automatically subscribed to the Organizer’s newsletter. In accordance with the Canadian Anti-Spam Law, each email message will include: 

  • clear identification of the sender, 
  • a simple opt-out mechanism, and 
  • withdrawal taking effect within a maximum of 10 business days. 


Withdrawal of consent does not affect entry to the contest. 


5. PRIZES 


The Contest Form shall specify: 

  • The number of prizes, 
  • A description of the prizes, 
  • Their approximate value, as required for fair disclosure under the Competition Act, and 

Prizes are neither redeemable for cash nor transferable, unless otherwise decided by the Organizer. 


6. DRAW AND WINNER SELECTION 


The draw shall be conducted on the date specified in the Contest Rules from among all eligible entries. The odds of winning depend on the total number of entries received. The award shall not be “unduly delayed.” 


7. REQUIREMENTS TO BE DECLARED A WINNER 


To be confirmed as a winner, the person must: 

  • Correctly answer a regulatory arithmetic question (mandatory in Canada). 
  • Provide the information necessary to receive the prize. 
  • Sign a liability waiver, if applicable. 
  • In the event of non-compliance or failure to respond within the time limit, a new participant may be selected.  


8. WINNER NOTIFICATION 


Winners shall be notified using the method specified in the Contest Form (email, phone, social media messages, etc.). If the Organizer is unable to reach a winner within 72 hours, at its discretion, another winner may be selected. 


9. PRIZE DELIVERY 


The terms and conditions for receiving the prize shall be specified in the Contest Form (postal address, collection, etc.). The Organizer assumes no responsibility once the prize has been awarded, and the winners shall hold the Organizer harmless from any claims related to the contest and the prize. 


10. GENERAL TERMS & CONDITIONS   


The Organizer shall reserve the right to amend, suspend, or cancel a contest, at its sole discretion, in the event of fraud, technical failure, or any other situation that makes it impossible to hold the contest. Any entry that is ineligible, fraudulent, or contrary to the Rules shall be rejected.  


11. ADVERTISING 


By accepting a prize, the winner authorizes the use of their first name, initial of their last name, image, or testimonial for promotional purposes related to the contest, unless otherwise notified in writing by the Organizer. 


12. PROTECTION OF PERSONAL INFORMATION  


In accordance with the Private Sector Personal Information Act, the Organizer collects personal information solely for the purposes of: 

  • administering the contest, 
  • contacting finalists/winners, 
  • registering participants for the newsletter, and 
  • analyzing its marketing performance.  


13. LANGUAGE 


All competitions are offered in French, in accordance with the French Language Charter, although an English version may be provided for informational purposes.  


 14. APPLICABLE LAWS 


Contests are governed by the laws applicable in Quebec and Canadian federal laws. 


15. LIMITATION OF LIABILITY 


The Organizer shall not be liable for technical failures, human error, lost entries, or delays caused by factors beyond its control; and participants shall hold the Organizer harmless from any claims related to the contest and the prize.  


16. GENERAL RULES  


The present General Rules apply to all contests organized by Cominar and its entities. 

Each contest includes a Contest Form containing variable information (dates, prizes, specific terms and conditions).
